The regular meeting of the Town Board of the Town of Clayton was held in the Board Room with the following present:

Supervisor Cantwell opened meeting at 5:00 p.m.

Judge Clarence Giles’s February 2005 report.  (See attached report.)

Letter from All Pest Inc. Re: no longer offering commercial pest control services as of April 1st, 2005.  (See attached letter.)

Quarterly statement from the Office of the State Comptroller, Bureau of Justice Court Fund Re:  Justice’s distribution of reports and fees.  (See attached statement.)

Letter from Joseph Colello, Frontenac Crystal Springs Re:  Price quotes from a competitor posing as Frontenac has been disseminating the written price quotes in an effort to discredit Frontenac, anger Frontenac customers; and to then solicit those same customers.  Frontenac has contacted the competitor and we are confident that the improper conduct has now stopped.  (See attached letter.)

Letter and Grant application from State of New York Unified Court System Re:  Justice Court Assistance Program 2005.  (See attached letter and grant appl.)

Letter from Nellie Mae Schauer Re:  Independent Public Libraries (Depauville Library and Hawn Memorial Library) have made the decision to request an increase in funding from the voters on the May 17th, 2005, School District Budget.  Petitions will be circulated beginning February 18, 2005, to increase funding for Depauville Library from $10,000 to $20,000 and Hawn Memorial Library from $15,000 to $30,000.  (See attached letter.)

Letter from Craig S. Kominoski, Real Property Analyst, NYS Office of Real Property Services Re:  Residential Assessment Ration for the Town of Clayton is 72.07.  (See attached letter.)

Letter from Jennifer L. Lauzon, Environmental Engineer, NYS DEC, Re:  Town of Clayton Land Clearing Debris Landfill inspection and report.  (See attached letter and inspection report.)

Letter from Jennifer L. Lauzon, Environmental Engineer, NYS DEC Re:  Routine inspection on Town of Clayton Transfer Station.  (See attached letter and report.)

Letter from Andrea Bazinet Dodson to Keith Wood, thanking him and the Town of Clayton for her many years experience working at the Recreation Park Pool.  (See attached letter.)

Supervisor Cantwell discussed:

His letter to Mr. Forkey on used cars and junkyard cleanup.

Supt. Boulton’s letter to Jim Lawrence, County Highway Supt. Re:  insight on snow and ice agreements in non-snow belt areas.

Fort Drum Regional Liaison  - Off base housing and 801 housing.

Motion by George Kittle, 2nd by Vivian Black to approve minutes from February 9, 2005 as written.  Motion carried.

 

HOME Consortium resolution:

RESOLUTION NO. 27 OF 2005 offered by George Kittle, 2nd by Donald Turcotte, a resolution for Supervisor Cantwell to execute on behalf of the Town of Clayton a cooperation agreement with the County of Jefferson to undertake or assist in undertaking housing assistance activities for the HOME Investment Partnerships Program.  Robert W. Cantwell Jr. aye, Vivian Black aye, George Kittle aye, Justin Taylor aye and Donald Turcotte aye.  (SEE RESOLUTION BOOK.)

Public:

Cheryl Howard, who is building a home in Heritage Heights, asked the Town Board about the Heritage Heights Sewer Extension and stated that she and her husband were in favor of the extension, which includes where they are building.  Supervisor Cantwell stated that the Board would be setting a public hearing at this meeting for the next town board meeting.

Supervisor:

Motion by Vivian Black, 2nd by George Kittle to approve Supervisor’s report from February 2005.  Motion carried.  (See attached report.)

Motion by Justin Taylor, 2nd by George Kittle to approve abstract #3 of 2005 voucher #247 thru #410 totaling $151,560.43.  Motion carried.  (See attached abstract.)

Supt. Boulton discussed Tri-State bill for damaged clothing.   He stated he would not pay the bill until they come and look at the clothing.

Heritage Heights Sewer District proposed addition:

Supervisor Cantwell discussed letter to Walt Jeram from Attorney Joseph Russell Re:  Heritage Heights Sewer proposed addition public hearing.

Motion by Donald Turcotte, 2nd by Vivian Black to set the Public Hearing for the proposed Heritage Heights Sewer District proposed addition for Wednesday, March 23rd, 2005, at 6:00 p.m. in the Board Room.  Motion carried.

ZEO IMA noncompliance:

Supervisor and Town Board discussed the ZEO IMA between the Town and the Village for Zoning Officer Henry LaClair’s salary.  The Village has not paid their share as per the agreement with the Town.  Councilman Kittle stated he would look into this matter to find out when the Town can expect payment.

Grant Administrator:

Supervisor Cantwell discussed the recommendation from the CLDC Committee for Grant Administrator for Frink America Project to be Sarah Baldwin.

DOS reimbursement action:

Supervisor Cantwell discussed the Dept. of State grant for Frink America, re-imbursement.  Consensus of the Town Board is to do the same over again, pay bills for the Frink project and get re-imbursed by the DOS.

Assessor ad:

Supervisor Cantwell discussed that he put an ad in at the N.Y.S. Association of Towns and that the applications must be in by April 1, 2005.

Website update, news and minutes:

Supervisor Cantwell stated that the news item is on the website and also the Board’s minutes.

Justice Court Assistance Program 2005:

Supervisor Cantwell will communicate with the Justices re:  Micro-fiche of Court records.

Highway Supt.:

Supt. Boulton discussed:

Equipment show on the 11th and 12th of May, 2005.

Highway Superintendents having their meeting here on the 11th of May 2005.

Centennial Park Project and the Village will be re-bidding the project.

Snow & Ice removal costs.

Hazmat training for employees.

Working at Transfer Site.

Boom mower out along roadsides.

Calibration of Depauville Sewer, done on 3/1/05, good for another year.

Motion by Justin Taylor, 2nd by George Kittle to approve Robert W. Cantwell Jr., Kathy LaClair, Henry LaClair, Jim Kenney, Harold Carpenter, Peter Brabant, Terry Lindsay, Bud Baril, Larry Aubertine, Ron Duford, Paul Heckmann and John Eppolito to attend the JCC Conference on Thursday, March 31, 2005.  Motion carried.

 

Committee Reports:

Vivian Black discussed:

Paynter Center doing well.

Hawn Memorial Library and Depauville Library asking for money through school taxes this fall.

 

George Kittle discussed:

Youth Commission had their budget meeting, very organized, fields discussed etc.

Chamber of Commerce – Meeting tomorrow, Thursday, March 10th, 2005, at 4:00 p.m.

Ice is off at the Arena on Monday, March 14th, 2005.

 

Justin Taylor discussed:

Consolidation Committee – 95% of the Clerk operation/staff is completed.

GIS – Town Clerk sent form FS-25 to State for 40% of Grant monies.

Association of Towns resolutions, all but 2 were passed.

Fire Dept.’s project to build on Graves Street.

Motion by George Kittle, 2nd by Vivian Black for Supervisor to send a letter of support of the Fire Dept. building on Graves Street.  Motion carried.

 

Donald Turcotte discussed:

Heritage Heights – developer will pay all costs including engineering & developing fees.  Also discussed gravity line from top to bottom.

Depauville Sewer:

Meeting with Jasper prior to their regular meeting with Rob Campany,        

Robert Boulton, Jasper Wilkie and Don Turcotte. 

25% delayed payments.

1st Friday, every other month starting 5/05 meeting times.

Beds cost $6,000. per bed – some mechanical problems now.

Install concrete tank-cap extensions, can pull cap & empty.

Will be done by bid process.

Supervisor Cantwell stated that the new closing date for Dep. Sewer Refinancing is April 7, 2005.

Recreation Park – ice off Monday, April 14th, 2005.

Transfer Site Bobcat garage – just about finished.

New Business:

Workshop meeting on March 23, 2005.

Motion by George Kittle, 2nd by Vivian Black to adjourn meeting at 7:08 p.m.  Motion carried.
