AMENDED MINUTES

The regular Workshop meeting of the Town Board of the Town of Clayton was held at the Depauville Community Center with the following present:

Supervisor Cantwell opened meeting at 5:00 p.m.

Town Clerk:

Motion by George Kittle, 2nd by Vivian Black to approve the minutes from August 10, 2005, as written. Motion carried.

Set Budget workshop dates:

Motion by Donald Turcotte, 2nd by Justin Taylor to set the Budget Workshop meeting for Wednesday, September 21st, 2005, at 5:00 p.m. and if needed continue the budget workshop at the regular workshop meeting on Wednesday, September 28th, 2005. Motion carried.

RESOLUTION NO. 40 OF 2005 offered by Justin Taylor, 2nd by George Kittle, a resolution to change 14040 Gustina Lane to 14040 Oak Tree Lane. Robert W. Cantwell Jr. aye, Vivian Black aye, George Kittle aye, Justin Taylor aye and Donald Turcotte aye. (SEE RESOLUTIN BOOK.)

RESOLUTION NO. 41 OF 2005 offered by Donald Turcotte, 2nd by Vivian Black, a resolution proposing the Lane off of 32333 CR 179 to be named 32333 Library Lane. Robert W. Cantwell Jr. aye, Vivian Black aye, George Kittle aye, Justin Taylor aye and Donald Turcotte aye. (SEE RESOLUTION BOOK.)

Public:

Douglas Eberhart asked when the Town was going to fill the Assessor position with a permanent Assessor; he stated that it wasn’t legal for the Town to assign an interim Assessor. Supervisor Cantwell stated that he had checked with the County Real Property Tax office and also checked with the Town’s Attorney, Mr. Joseph Russell, and that it was the appropriate action to take. The Town of Clayton is conferring with the Town of Orleans to possibly appoint an Assessor for both the Townships to save money and also to bring in an experienced person who might have to move here from another area and it would make it worth that persons while to do both Townships. Supervisor Cantwell stated that by sharing services it would save both Towns some money. Supervisor Cantwell stated that the Town of Orleans is about ready and that it would be advertised shortly.

Sherie Derrickson asked the Town Board if the School had asked the Town to use the Pool at Recreation Park after closing to the Public. Supervisor Cantwell stated that Keith had received the request and that the school would have to pay for fuel, chemicals and the guards.

Supervisor:

Trying for 8/31, as last day for pool:

Supervisor Cantwell stated that the last for the pool to be opened would be 8/31/05.

Action on Planning & ZBA IMA’s:

Supervisor Cantwell discussed the changes to the IMA’s with the Town Board.

Motion by George Kittle, 2nd by Justin Taylor to approve the amended Planning & ZBA IMA’s. Motion carried.

Seaway Trail request:

The sign created by the Seaway Trail has a grant to only cover 80% of the cost. They are requesting that the Town pick up 20% cost ($920.00). The Town does not have an obligation to pay, but would help the Seaway Trail’s sign program. Supervisor Cantwell stated that the Board could discuss this again at the next Town Board meeting.

EPA Brownfield Conference, 10/31 to 11/4:

Supervisor Cantwell discussed the EPA Conference in Denver on 10/31 to 11/4, and possibly being presenters at the conference and the funding from EPA. Consensus of the Town Board is for Supervisor Cantwell to attend the EPA Conference in Denver.

Sewer Pumping bid:

Town Clerk opened the Sewer Pumping bids for Depauville. Town received 4 bids:

  • Bach & Co. - $195.00 each unit, Emergency basis $250.00 each unit.
  • Gleason’s Septic - $$205.00 each unit, Emergency basis $225.00 each unit.
  • Mellon & Daye - $165.00 each unit, Emergency basis $195.00 each unit.
  • Pommerville’s Septic - $$149.00 each unit, Emergency basis $175.00 Ea unit.

    Motion by George Kittle, 2nd by Justin Taylor to award the Pumping of the Depauville Sewer to Pommerville’s Septic Service subject to review by Supt. Boulton and Councilman Donald Turcotte. Motion carried.

    Workshop:

    Street Lights:

    Supervisor Cantwell discussed street lights in different locations, (Factory Street and Eliza Street) and stated that the cost of putting in the lights would go to the District and the residents would have to pay for it. The public present saw no need for additional lighting at this time.

    Depauville proposed Water District:

    We have the ability to move ahead and to form the District with 55.77% of the residents signing the petition.

    Sequence of Events:

  • Forming district.
  • Engineer funding.
  • Need to have more residents sign petition to have the numbers for grants or funding, more percentage signing, better funding.
  • Supervisor Cantwell stated to do a district, need to notify Comptroller, Health Dept. and Dept. of Environmental Cons., there is a need to apply as soon as possible. Need to set Public Hearing at the next Town Board meeting (10 days prior notice). Consensus of the Town Board is to start as soon as possible.

    Depauville Community Center:

    Parking:

    Town Board discussed the possibility of blacktopping off of the new Library Lane, a place to park 10 or more cars.

    Depauville Sewer Dist.:

    Asset replacement program:

  • In near future work on Sand filters.
  • In good shape with the pumps (1 replacement pump for system, can run on 1 pump if 2 go down).
  • DEC, our % of removal was 99.6 on Bogs, suspended solids was 97%.
  • Standard life of beds is 10 years, Supt. Boulton has stretched out life of the beds so don’t have to replace all at one time.
  • Depauville Playground:

    Town Board discussed if there was a need for a skateboard area, and there is no need for this. Town Board discussed a basketball area on the driveway side, to help the tennis players.

    Depauville gazebo:

    Sheila Reff asked about the electric at the gazebo. Supt. Boulton stated a convenience drop is scheduled to be hooked up between 8/29/05 – 09/02/05. Ms. Reff thanked Mr. Boulton for doing a nice job.

    Other:

    Town Board and Depauville residents discussed Outdoor Wood Furnaces. Reba Cervantez stated that they are very smelly and she has to close her windows when her neighbors burn their wood stoves. Supervisor Cantwell stated that in order for the Town to do anything, the residents need to petition the Town to look at certain issues. Cornelia Schnauber asked if the Health Board could do anything (Consolidated Health Board). It was stated that they have no jurisdiction. Councilman Taylor suggested that the Town Board look at thoroughly before acting on this.

    Other concerns were dogs, dirt bikes and four wheelers.

    Councilman Turcotte stated that Keith Wood would attend the last meeting in September to discuss the age of equipment and energy costs at Recreation Park. Mr. Turcotte also stated that the tire program at the transfer site was operating at no cost to the taxpayers.

    Motion by George Kittle, 2nd by Vivian Black to adjourn meeting at 6:33 p.m. Motion carried.
