The Town Board of the Town of Clayton held
a regular workshop meeting at the Village Municipal Building
with the following present:
Robert W. Cantwell Jr., George Kittle,
Justin Taylor, Donald Turcotte, Bonnie Rose, Kathy LaClair, Bob
Boulton, Nicole Cornaire, Jim Yuhas, Michael Docteur, Sharie
Derrickson (TI Sun), Lena Black, Keith Huchzermeier
Minutes:
Motion by Bonnie Rose, 2nd
by George Kittle, to approve these minutes as written. Motion
carried.
Proposed Depauville Water:
Clarification by Deputy Clerk Nicole
Cornaire concerning information given at the last Town Board
meeting by the Opposition Committee. Deputy Clerk Cornaire
indicated that she was not asked for any updated information the
last time Ms. Black was in the office. Ms. Black was in the
office only to obtain a receipt, which the Town Clerk issued,
for two (2) signature revocations submitted. At that time Ms.
Black didn’t ask for any updated information.
Depauville Library Asbestos Abatement
Bids:

Councilman Turcotte discussed Keith Wood
doing some in house work. Also there maybe some funds available
through the Library. Councilman Turcotte would like to see this
project moved forward.
Motion by Donald Turcotte, 2nd
by Bonnie Rose, to award to the lowest qualified bidder subject
to review of the Town Engineer. Motion carried.
Further discussion that any money would
come out of the Capital Account.
Laundromat Water Line Easement:
Supervisor Cantwell stated he had received
a letter from Patrick D. Phinney of Phinney Holding INC, DBA The
Victorian, who is asking for an easement and permission to
install at his expense, a new water line to run from Purcell
Drive through the Town property to the East End of his building
for the purpose of supplying water for a Laundromat. (See
attached.)
Motion by Bonnie Rose, 2nd by Justin
Taylor, to approve, pending Mr. Phinney also securing approval
from the Village of Clayton as partners at the Joint Highway
Facility. Motion carried.
Proposed Depauville Water District:
Keitha Huchzermeier stated that she had
seen in the paper where two (2) more people had signed the
petition and also the group in support of the district had sign
out the petition book. As part of the opposition group she is
wondering if they can also sign out this petition book.
Board discussion followed with Councilman
Taylor stating the reason for the group in support signing out
the petition book was to see if anyone else is interested in
having the district. In discussions with Atty. Joe Russell, it
was indicated that if there weren’t enough signatures, then the
Town could take no further action. Therefore it would not help
the opposition group to take the petition as no signature is a
no vote.
Public:
Mike Docteur, Co. Legislator –
Sales Tax: We want to continue the ¾%. The County needs
“Home Rule” from the Senate & Assembly. He indicated that we
have until 11/07 to get this done. It would help if the Town
Board either individually or collectively contact our Senator &
Assemblyman to express our need and ask them to support the
continuance.
Jeff. Co. Jail: On 4/10 the
committee will address this issue. He believes they will
continue to move forward. He has been working with the Sheriff
Dept., the issue might be whether to do one (1) or (2) pods. We
need to look ten (10) years down the road.
3 phase Power: We’re waiting for
the paperwork to be submitted by both companies.
Heritage Heights: The valves have
been ordered. When they come in we will schedule to get the job
completed.
Joint Planning & Zoning Board of Appeals
IMA’s:
Both have been sent to Atty. Russell for
review. He will track all changes and respond back to us.
Zoning Enforcement Officer IMA:
The signed IMA was received from the
Village this afternoon. Supervisor Cantwell has signed this
agreement and it has been filed in the Town Clerk’s Office.
Supervisor Cantwell also stated that a
Proposed Zoning Office Budget was submitted to the Village today
along with the completely signed ZEO IMA. (See file.)
T. I. E. R. S.:
The 4th Quarter 2006 report &
Year End Report has been received from TIERS and has been filed
in the Town Clerk’s Office. (See file.)
Opera House Report:
Supervisor Cantwell distributed an Opera
House Renovation Report with the updates from the March 28th
highlighted. (See attached.)
Supervisor Cantwell also gave Board members
a copy of a letter from Mary Mascott to neighbors Mike Buker &
Allen Benas, thanking them for allowing the contractors for the
Clayton Opera House Renovation Project to use their parking
facilities off Merrick Street an to confirm the repair and
resurfacing which will be done when the renovation project is
complete. (See attached.)
Supervisor Cantwell indicated that Mary
Mascott will come to the Town Board in May requesting help in
paving the parking lot.
Councilman Taylor inquired if it is
possible to do the 3 phase power to the Opera House
underground.
Supervisor Cantwell indicated that it more
than likely will not be done underground due to the cost,
however it is scheduled to come from the Merrick Street way
inside of across park of the downtown area.
Seaway Trail Sign:
Supervisor Cantwell distributed a rendition
of the Seaway Trail sign being provided by the Opera House at a
cost of $250. It will be located close to the building on the
John Street side.

by Donald Turcotte, to allow placement if the sign in this
location. Motion carried.
Frink Remediation Report:
Supervisor Cantwell indicated that the
Remediation Committee would be meeting next week, Tuesday, in
the downstairs meeting room.
Supervisor Cantwell distributed a Frink
Report with revised March 28th information
highlighted. (See attached.)
Start date for remediation will be June
2007 and after speaking with the DEC’s new region
representation, they’ve strongly recommending no bio cell off
site. (See attached.)
Supervisor Report:
Supervisor Cantwell recapped from 1990
forward the following: The tax rates had changed thru the years
however we hadn’t increased the tax rate with the exception of
TIERS for 17 years. The Capital Fund in 1994 was $74,000 and
now in 2007 the Capital Fund is $92,798. The Buildings &
Grounds have kept-up. The Highway Building is now 10 years old
and all the facilities are in good condition. There are two (2)
major projects which are the $1.8 mil funding grant for Frink’s
and the $3.2 mil funding grant for the Opera House at no local
taxpayer’s debt.
Supervisor Cantwell stated he hoped to be
remembered and anytime someone discusses TIERS, Frink America
Development & the Opera House Project he hopes that he is
remembered for the work he has done for these projects. He
hopes to be remembered by the employees as being fair,
especially with negotiations. He feels that the Highway and the
Town of Clayton in general is the premier in the County.
Cemeteries:
Town Clerk Kathy LaClair distributed
folders to the Board Members from Richard Barton, LaFargeville.
Mr. Barton will attend our next meeting and hopes that the Board
Members will review the folder prior to that meeting.
Highway Report:

The Dept. of Labor has rescheduled a school date for 4/26
due to inclement weather yesterday.

CPR & First Aid will be taught to each of the Highway
personnel. This class will be taught through TIERS and will
costs $30.00 each. Consensus of the Board to go ahead with
this.

Supt. Boulton has received the permit back from the City
of Watertown for the dumping of waste/waste water from
Depauville.

Supt. Boulton received a letter from Cornell University
Cornell Local Roads Program. This will be Mr. Boulton’s
eleventh year of attendance. He will receive his tenth year
certificate this year as they award the year after. This year’s
school will be June 4,5 & 6. (See attached.)

attend this schooling. Motion carried.

Moving Wall: Will be at Rec. Park on 5/20-5/25. FYI the
Command Center will be at the Joint Highway Facility in the
lunch room. Trash removal will be taken care of.

Surplus equipment will be auctioned off in June. (Dozer
& OshKosh)
