The Town Board of the Town of Clayton held
a regular workshop meeting at the Village Municipal Building
with the following present:

Boulton, Nicole Cornaire, Shari Derrickson, Jasper Wilkie, Bill

Minutes:
Motion by George Kittle, 2nd
by Bonnie Rose, to approve 2/14/07 minutes as amended. Motion
carried.
Motion by Donald Turcotte, 2nd
by Justin Taylor, to approve the 1/10/07 minutes as amended.
Motion carried.
Resolutions & Motions:
Resolution #29 was offered by Justin
Taylor, 2nd by George Kittle, to authorize Supervisor
Cantwell to sign the Bed Tax Contract between the Town of
Clayton and Chamber of Commerce for $9,934.00. Robert W.
Cantwell Jr. – aye; George Kittle 0 aye; Justin Taylor – aye;
Donald Turcotte – aye; Bonnie Rose – aye. Motion carried.
Motion by Bonnie Rose, 2nd
by Justin Taylor, to recognize the hiring of Dustin Patchen as a
part-time employee of Recreation Park, starting at $8.00 per
hour retro to 1/11/07. Motion carried.
Public:
Bill Udart spoke against the Depauville
Water District Petition . (See attached.)
Workshop:
Depauville Asbestos Abatement:
Two (2) quotes have been received by
Bernier Carr & Associates. They had sent specs asking three (3)
businesses to give a quote. One firm sent back two quotes: (1)
for just the bathrooms, (2) was for the whole project at the
Community Center.
Consensus of the Board was to turn the
quotes back to BCA to get quotes solely for the bathrooms at the
Community Center.
ZEO IMA and Assistant Status:
Supervisor Cantwell stated that
negotiations with the Village concerning a sentence inserted in
the IMA by the Village for evening hours for the zoning office,
has resulted in different verbiage being utilize to indicate,
after a six month apprenticeship, approximately June 2008, two
hours of evening hours would be tried by the Assistant ZEO to
see if evening hours are warranted.
Councilman Taylor indicated that once the
Village agrees to this new language, he would like to see this
contract housed with our Lawyer and any future changes be done
by the Lawyer.

ZEO Proposal for Training Planning & ZBA
Members:
Memo was given to the Town Board
Members by ZEO Henry LaClair. In attending Assoc. of Towns
sessions, Mr. LaClair obtained a sample resolution and altered
the resolution to fit our Planning & ZBA Boards for training.
Starting this year all Planning & ZBA members are required to
have four (4) hours of training per year. Mr. LaClair had
indicated that previously the Town Board had a resolution which
was not a mandate and this new resolution would mandate
training.
Supervisor Cantwell asked the Town Board to
read this resolution over and be prepared to act on at the next
meeting.
ZEO Assistant Applications:
Councilman George Kittle stated the
committee met last Saturday morning to review the applications.
Six applications were received, the committee narrowed down to
three (3). The three (3) that were not selected will be sent
letters thanking them for applying and told their applications
will be kept on file. The three (3) selected applicants
selected will be called for interviews sometime the end of March
as Pl. Bd. Chairman Baril is away until then.
Justice Court Renovation Project:
The two (2) unused bays of the former Fire
Dept. will be converted into the new justice court system.
Councilman Justin Taylor stated he attended sessions at the
Assoc. of Towns which indicated that all changes are coming from
the Office of Court Administration and some changes will be
funded by the OCA. Mr. Taylor indicated that a “multi-purpose
room” can be utilized however security measures would need to be
implemented.
The Town & village of Clayton have filed a
joint grant application in the amount of $400,000.
Opera House Update:
Supervisor Cantwell distributed an Opera
House Rental Rates sheet. (See attached.) TIPAF will be
doing all contracts starting this season.
Supervisor Cantwell also discussed the
Letter of Agreement with TIPAF dated 5/3/03. At that time the
Town committed to paying all utilities. Mary Mascott has
re-wrote the agreement to bring it current. Supervisor Cantwell
noted there is a section concerning Buildings & Grounds which is
Town. It‘s only purpose is as an O & M for the building. Mrs.
Mascott would like to see this contract entered into as soon as
we can.
Consensus of the Town Board that Supervisor
Cantwell & Councilman Taylor check all aspects of the contract
first.
Wind Energy Facility Permit Application
Status:
Councilman Taylor attended last Thursday’s
Planning Board meeting where that Board declared a “positive”
declaration and accepted a Draft Generic Environmental Impact
Statement. Utilizing a “draft generic” allows for more
flexibility of updating, etc. Councilman Taylor indicated that
there will be several open comment dates and a SEQRA Workshop to
ask questions, there will be public hearings and a notice sent
to all Town of Clayton residents and people will be able to
review the DGEIS in the Town Offices, by CD, Web site, and a
hard copy to be located at the Public Libraries.
Water Is Life Meeting:
Councilman Donald Turcotte stated he
attended the meeting held in Depauville and there were
approximately 20-30 people that also attended. Rob Campany of
Bernier, Carr & Associates, Tom Boxberger of the State Dept. of
Health, and Ralph Downey of Village of Clayton Water & Sewer
Dept. were in attendance to answer questions. Councilman
Turcotte indicated that both good oral commentary and visual
aids were utilized.
One $4 million dollar business in
Depauville stated they need good water in order to keep their
business in Depauville.
Supervisor Association Meeting:
Councilman Taylor attended this meeting
held at Brownville. There were in attendance 10 Supervisors, a
couple of Mayors and a couple of County Legislators. The
consensus of those attending to send word back to the County
Legislators and ultimately back to Sen. Wright, this money is
being utilized to eliminate raising property taxes and that this
Association endorsed keeping the ¾ of a cent tax.
Councilman Taylor indicated that if this
tax were removed the impact would be as follows using last
year’s figures: Town $77,180; Village $30,220.
18th Annual Local Government
Conference:
The conference this year will be held on
Thursday, March 29th at Jefferson Community College.
Pre-registration will be secured for the following people:
Kathy LaClair, Henry LaClair, Jim Kenney, Harold Carpenter,
David Storandt, Darrel Hayes, Larry Aubertine, Phil Randazzo,
John Eppolito, Bonnie Rose, Bob Cantwell Jr., and Gail
Richardson.
Association of Towns Comments:
George Kittle: Broader topics than
previous years and enjoyed listening to all the politicians.
Justin Taylor: We’re exposed to a broader
scope of what is going on in the state.
Different sessions distributed resources
ie: web sites, etc. Interaction with various other elected
officials gives a wealth of information.
Bob Cantwell: The Vendors are also a good
source to spend time with.
Kathy LaClair: Difficult this year to
attend several full sessions as several topics overlapped. Tax
Collection sessions were 2 & 3 hours long which would have
interfered with the Clerk sessions. I spent the first & third
hour with tax collection and attended the Clerk’s sessions. The
best part aside from getting updates is the interaction during
the question and answer portion. Seeing how other
municipalities deal with like situations and getting assurances
from the speakers that you’re doing things correctly.
Assoc. of Towns Voting:
Councilman Taylor stated all resolutions
had passed. There have been some changes in the Vehicle &
Traffic Law concerning ATV’s. Previously ATV’s could use Town
roads “only to access a trail” and it is being changed to leave
it up to the Town Boards to decide.
Also voted and passed was to be totally
against any unfunded mandates.
Highway:

Tomorrow Bob Parker, Dept. of Labor will be holding a
safety training session at Rec. Park from 8 – noon.

Yesterday, Highway Superintendent Boulton was working
with EMSHA (Mining). That department has just hired 150 new
inspectors. Mr. Boulton would like to see a 911 number for the
mining location.

Heritage Heights Sewer: we have a problem yet with one
pump which needs a new gauge.

Depauville Sewer: Tanks are being pumped today.
Watertown states a permit is now needed to dump in the city.
They will be sending down a permit to fill out and a $250
application fee is required.

Town Hall Water & Sewer lines: Discussion; Consensus Town
will pay for materials and the Village will do the work.

Frink Development Site: Superintendent Boulton is getting
ready to start at this location as soon as weather permits.

Salt – was getting low and had to reorder.
