The Town Board of the Town of Clayton met at the Village Municipal Building with the following present: Robert W. Cantwell Jr., George Kittle, Justin Taylor, Donald Turcotte, Bonnie Rose, Bob Boulton, Kathy LaClair, Jim Yuhas, Mike Docteur, Kelly Vadney(WDT) Joe Natali (5:30) Supervisor Cantwell opened the regular meeting at 5:00 PM. Town Clerk: Correspondence: - Judge Clarence Giles September 2006 Report. (See attached.) - Judge Clifford James September 2006 Report. (See attached.) - Notice from Northern NY Library Network presenting on Wed., 10/25/06, Preservation Series Part 3 – Basic Preservation of Photographs at their Potsdam location. This is a full day of Continuing Education. (See attached.) - Northern Regional Center for Independent Living – October issue of Focusability. (See attached.) - Fire District meeting minutes of 9/13 and agenda for 10/11. (See attached.) - Notice from Jefferson County Dept. of Planning, Center for Community Studies @ JCC, and NYS Tug Hill Commission of a training session on NYS Environmental Quality Review (SEQR). Training will be held Wed., 10/25 from 6:30 – 8:30 in the Jules Center Amphitheater (Rm. 6-002) Jefferson Community College. (See attached.) - Letter received from Arthur & Mary Krahn dated 9/27 pertaining to resurfacing and widening Kehoe Tract Rd. (See attached.) - Letter from Ted Mascott, Immediate Past President of 1000 Islands Land Trust dated 10/11/06, asking for a letter of support for a grant application to construct the Historic Zenda Farm Trail. (See attached.) - Received a copy of the “Friends Focus” from Hawn Memorial Library. (See attached.) - Received letter dated 9/22, from David R. Dingman, Asst. Resident Engineer, Reg. 7, State of New York, Dept. of Trans. Concerning Municipal Snow & Ice Agreement Operational Plan for the 2006-2007 Snow & Ice season. (See attached.) - Received letter from State of NY Dept. of Trans., Dennis P. Pawlicki, Assistant Regional Transportation Maintenance Engineer, dated 9/21 concerning Municipal Snow & Ice Agreement to plow & sand certain State highways in the Village & Town of Clayton. (See attached.) - Letter dated 9/22 from Kelly Davis, Jeff. Co. Auditor concerning Tax Relevies for next year. (See attached.) - Letter dated 9/21 from NYS Environmental Facilities Corp. concerning Drinking Water State Revolving Fund Final Regulations Revisions. (See attached.) - Letter dated 10/5/06 from State of New York, Christopher Jacobs, Sec. of State concerning a commitment by Gov. George Pataki of $3 Mill dollars in the 2006-2007 Environmental Protection Fund to the Quality Communities Grant Program. Applications need to be received @ the DOS no later than 4 PM Friday, 11/17/06. (See attached.) Points of Interest: - Our new Verizon Representative made introduction. - There will be an Employee meeting @ 7AM tomorrow morning at the Joint Highway Facility. Discussion will be updating personnel about the Frink Development Project. Minutes: Motion by George Kittle, seconded by Bonnie Rose, to approve the minutes of 9/27 as written. All in favor. Resolutions: Resolution #45 of 2006 offered by Bonnie Rose, 2nd by Justin Taylor, for the Town of Clayton to do a lease purchase agreement for an Asphalt Zipper, Model AZ-500. Cantwell - aye, Kittle - aye, Taylor - aye, Turcotte – aye, Rose – aye. (See Resolution Book.) Resolution #46 of 2006 offered by George Kittle, 2nd by Donald Turcotte, to support the Thousand Islands Land Trust in their quest for funding a Recreational Trails Program at Zenda Farm. Cantwell – aye, Kittle – aye, Taylor – aye, Turcotte – aye, Rose – aye. (See Resolution Book.) Resolution #47 of 2006 offered by Justin Taylor, 2nd by Donald Turcotte, to partner with the Village of Clayton to submit a joint application, with the Village as Lead Agent, to the New York State Department of State’s Shared Municipal Services Incentive (SMSI) Grant Program for the 2006-2007 Program year to explore the feasibility of co-locating offices, either in part or in whole, of each municipality in one building. Cantwell – aye, Kittle – aye, Taylor – aye, Turcotte – aye, Rose – aye. (See Resolution Book.) Resolution #48 of 2006 offered by Bonnie Rose, 2nd by George Kittle, to partner with the Village of Clayton to submit a joint application, with the Town as Lead Agent, to the New York State Department of State’s Shared Municipal Services Incentive (SMSI) Grant Program for the 2006-2007 Program year for a Sand Shed. Cantwell – aye, Kittle – aye, Taylor – aye, Turcotte – aye, Rose – aye. (See Resolution Book.) Letter of Support – Consensus of the Board, for Supervisor Cantwell to do a letter of support to Bernadette Castro for the Islander Marina. Set Special Town Board Meeting: Motion by Justin Taylor, 2nd by George Kittle, to set a Special Town Board meeting of 10/19/06 at 5PM, to take action on re-bid of General Contractor for the Opera House Renovation Project. All in favor. Set Public Hearing for the 2007 Budget: Motion by George Kittle, 2nd by Bonnie Rose, to set the public hearing date of 10/25/06 at 6PM for the 2007 Budget. All in favor. Public: Jeff. Co. Leg. Mike Docteur stated that he didn’t have very much for this evening. He would be attending this evening’s Chamber of Commerce Dinner at the Clipper. Also he is aware of the power line problem, concerning painting buildings, on Riverside Dr. and has been in contact with Sen. Wright’s Office to see if there are grants available to bury power lines in the Village. Supervisor’s Report: Motion by George Kittle, 2nd by Bonnie Rose, to approve as submitted the Supervisor’s Report for September 2006. All in favor. Supervisor Cantwell indicated that if the CLDC has not been reimbursed from grants by our November Financial meeting, he would then like to loan the CLDC $50,000 so that they can pay bills and it would be repaid when grant money came in. Bills: Discussion of the GasBoy Maintenance bill followed. Councilman Taylor indicated that we need to bill the Fire District, TIERS, etc. for their proportionate shares. Motion by Justin Taylor, 2nd by Donald Turcotte, to approve Abstract #10, Vouchers #1167 - #1281, in the amount of $157,749.16. All in favor. Budget Transfers: Motion by Bonnie Rose, 2nd by George Kittle, to approve budget transfers as presented. All in favor. – Tracey Road Equipment Highway Superintendent Boulton expressed his purpose for purchasing is needed due to large jobs, such as Frink’s. Motion by Bonnie Rose, 2nd by Justin Taylor, to award the bid from Beam Mack Sales & Service, Inc. at $65,000.00 for the 2004 Mack CX613 Heavy Duty Tandem Axle Tractor, subject to review of the bid by Supt. Boulton. All in favor. Motion by George Kittle, 2nd by Don Turcotte, to award the bid from Tracey Road Equipment at $46,670.00 for the New 2006 J&J Trailer, Model DT, subject to review of the bid by Supt. Boulton. All in favor. Frink Remediation Update: It has been determined that there will be up to 19,000-20,000 tons of material being excavated from the Frink site. Because of that volume, and the cost factor, there is a need to look at what goes to the Rodman Landfill. Supervisor Cantwell indicated that it is more cost effective for the project if the Town does a bio-cell at our property located corner of NYS Rte. 12 & County Route 5 for a portion of the materials and is all subject to DEC approval. Approximately 75% is light oil contaminates which would be put in the bio-cell; the other 25%, or approximately 5,000 ton would go to Development Authority North Country (DANC), which is heavy oil material. The Town has experience with bio-cells as we did one at the Joint Highway Facility. The cost is $25.00 per ton to dump at the Rodman Landfill. If all materials where going to DANC, it would cost $500,000. By doing a bio-cell ourselves, only $125,000 would be going to DANC and we would be saving $375,000. on payments to DANC and addition savings for less transportation mileage. Frink BAN: Supervisor Cantwell reported the 1st BAN in the amount of $500,000 comes due on Wednesday, 10/18. We will be lining this BAN up to come due the same time as the 2nd BAN we did for $250,000. Capital project schedule update: Not completed at this time, possibly in November. Sick Time Banking Discussions: This proposal is open for discussion for paying health benefit premiums after leaving employment and coming from banked unused sick time. Supervisor Cantwell appointed Justin Taylor and George Kittle to this committee. Highway Report: - Zipper – We have done the Resolution, but now need a letter of Opinion of Counsel. - Town Board members have hopefully seen construction being done for the temporary Town Offices. - Mowing now on Grindstone Island, cutting back the corners, hoping to be completed in 4 or 5 days. - County personnel, Jerry Babcock has started as a seasonal employee for the Town as a wingman. Motion by Bonnie Rose, 2nd by Justin Taylor, to hire Jerry Babcock as Seasonal Part-time at $12.00 per hour starting 10/10/06. All in favor. - Stouts, Brier Hill will be doing sand for filter beds in Depauville, starting this week. They are currently the only source for filter bed sand in this region. - Started putting fall equipment on line. - New sander hasn’t arrived yet, but is on the way. Committee Reports: Bonnie Rose - Paynter
Senior Center – Will be attending the meeting - Hawn Memorial Library – You just received their pamphlet. - Highway Dept. – Was up talking to Bob & Candie about everything discussed by the Highway Supt. - Starting tomorrow Highway personnel back to 5 days/weekly, 8 hours/daily. George Kittle - Youth Commission – Nothing to report. - Village did finally send $6,500 portion. Now there is money in this account. - Dugouts – there is money available to do the roofs from the Youth Commission fundraising. - Chamber of Commerce – Voice his displeasure that again they have their dinner meeting on our Board Meeting night. If they want participation from the Town, they will have to not schedule for our meeting nights. - Windfarm Committee: Met again this past Monday evening; the meeting last Tuesday had PPM also in attendance. Our committee will be making recommendations as to what the overlay district is, where it will go, to the Town Board and Planning Board. Timeline is important. Justin Taylor - Had a
meeting last week with a Westelcom - Centrex: Spoke with our present company. We’re charged on every line we have coming into the Town offices. We have eight (8) lines at present. Office of General Services (OGS) charges $15.75 a line. We need to do an evaluation on this when we come back to the Town Hall. - GIS: Need to get together with the Assessor & ZEO. - Craig Turrisi letter concerning possible abandonment by the Town of the road which leads to the North Shore on Grindstone Island. Councilman Taylor’s position is that this needs to remain open for public access. The right-of-way on private property is a different story. The Town access needs to remain open. Committee: A copy of the committees report - Depauville Sewer pump is back on line. - Heritage Heights: Another parcel has sold, therefore another sewer addition will be forthcoming. - Recreation Park: Keith was away the day I checked in the other day, so didn’t get an update.
